While raising objection, we must be very careful. Law exist, but courts takes linient view in implementing such laws which are against the lady. Through this writ petition, petitioner has challenged the order dated 09.07.2010, passed by learned Additional Sessions Judge, Hasilpur. 2. Brief facts of the case are that respondent No.2 got lodged a case FIR No. 80/2010 under Sections 337.F(v)/337.L(ii) PPC at Police Station Qaimpur Tehsil Hasilpur District Bahawalpur against the petitioners. Black's Law Dictionary defines estoppel as a "bar or impediment raised by the law, which precludes a man from alleging or from denying a certain fact or state of facts, in consequence of his previous allegation or denial or conduct or admission, or in consequence of a final adjudication of the matter in a court of law". Estoppel in its broadest sense is a legal term referring to a series of legal and equitable doctrines that preclude "a person from denying or asserting anything to the contrary of that which has, in contemplation of law, been established as the truth, either by the acts of judicial or legislative officers, or by his own deed, acts, or representations, either express or implied." This term appears to come from the Old French estoupail (or a variation), which meant "stopper plug", referring to placing a halt on the imbalance of the situation. DYING DECLARATION

A statement, which is given by the dying person is called as dying declaration and that is about the cause of his death or to any of the circumstances of the transaction which resulted in his death. DYING DEPOSITION: Dying deposition is almost a dying declaration. The main difference is that it is always recorded by a magistrate in presence of the accused or his/her lawyer. The Magistrate records the evidence after administering oath in presence of the accused or his lawyer. (rayz jest-tie) Latin words for "things done". It is a noun. It  means (in law) the events, circumstances, remarks, etc. which relate to a particular case, especially as constituting admissible evidence in a court of law. It means all circumstances surrounding and connected with a happening. Thus, the res gestae of a crime includes the immediate area and all occurrences and statements immediately after the crime. Statements made within the res gestae of a crime or accident may be admitted in court even though they are "hearsay" on the basis that spontaneous statements in those circumstances are reliable. The rule as to admissibility of evidence as res-gestae, is embodied and illustrated in articles (19), (20), (21), (22) and (27).
