Keeping Contact with the Judge as you Argue
"Keeping contact with the judge as you argue"
Preliminary Note;
"Now in court"
This court in which we sit is a temple of Justice, and the Advocates at the bar as well as the judges on the bench are equally ministers in that temple.
It is a good practice to be in a court room before your case is called . judges when they enter the court room always note who r already present in the court and when you rise promptly on the call of your case, they get a positive impression abt your presence. Being earlier in the court also gives you time to properly arrange your files books and documents.
Finally' listen to David pannick Q.C who has conducted well known cases in recent history in UK.
He has strongly recommend " lawyer should ens that he is present at the beginning of the hearing.
The absence form the court when his case is called may amount to contempt.
I never read out lengthy passages from rulling and throughout my practice at most cited the name of the case its history if necessary and the principles it decides if u get lost into the reading of the ruling you will find that you have left your own case and giving facts of another case.
David Ross Q.C says he " never read out slabs from a precedent".
Conclusion:
Avoid using "My lords" your honor too often.i have noted some lawyers using the honorific in the beginning of each sentence and sometimes at the end.this show lack of confidence and is unnecessary.remember that you have to maintain an intellectual equality with the judge.
Always remember that you r an advocate who is seeking to persuade the judge and not impress him.
One of the most experienced and famous lawyer Barrister D.F jeckon Q.C in his immutable style concluded in one of his articles:-
" Witty observation which blossomed in chambers tend to wilt the under acid rain of the Court room.
